Daisy Kell-Jones successful in an appeal against sentence at the Court of Appeal
Daisy represented the appellant in an appeal against a sentence of 22 months’ imprisonment imposed for dangerous driving, breach of a Criminal Behaviour Order (“CBO”) and possession of an offensive weapon. Daisy argued in front of Lord Justice Dingemans, Mr Justice Freedman and HHJ Norton that the sentence imposed in the lower court was manifestly excessive due to the failure to impose a reduction to reflect the Appellant’s youth and immaturity, in line with Clarke [2018] EWCA Crim 185. Daisy also argued that the sentence for breach of a CBO was incorrectly categorised within the sentencing guidelines.
The Court of Appeal agreed with both submissions and reduced the sentence to a total of 61 weeks imprisonment (a little over 14 months) meaning that the Appellant will be imminently released.
