Daniel Sternberg successfully resists High Court challenge to extradition of man accused of double murder in Brazil

The Divisional Court dismissed an appeal brought by Alisson Pimenta against the order for his extradition to Brazil on 19 October 2017. Mr. Pimenta is wanted for a double murder committed on 17 August 2013 following a dispute between neighbours at a party. It is alleged that he shot two men, causing their deaths and that he subsequently fled to the UK

Mr. Pimenta challenged his extradition on the basis that prison conditions in Brazil would violate his right not to be held in inhuman and degrading prison conditions and his right to a fair trial (under articles 3 and 6 of the European Convention on Human Rights). The High Court accepted Brazil's arguments that Mr. Pimenta's extradition would not involve a breach of his Human Rights.

It is only the second time in recent years that extradition to Brazil has been approved by the High Court.

Daniel Sternberg appeared on behalf of the Government of Brazil. He specialises in extradition proceedings under both parts 1 and 2 of the Extradition Act 2003 and appears for both requesting states and defendants.
