James Waddington QC appeared for the Respondent in an appeal by Darren Say, an independent financial advisor, against his convictions for fraud by abuse of his position and fraudulent trading.  The charges related to the spending by him of money allocated to SIPPs in the names of his clients and earmarked for investment in the West Indies. In connection with his argument that he had acted lawfully and honestly, the case involved, among other things, an examination of the Appellant's business plan and commercial documents as well as relevant pensions' legislation.
