James Gwatkin secures acquittals for Defendant tried in absence
James Gwatkin represented AS in a trial that took place between 17/05/2021 and 19/05/2021 at Harrow Crown Court. AS did not attend his trial and the case proceeded in his absence. James stayed on to represent AS. AS was charged with possession of an offensive weapon, common assault and racially aggravated words or behaviour with intent to cause harassment, alarm or distress. The whole incident was captured on mobile phone footage.
James successfully applied to exclude comments made by AS prior to arrest pursuant to s.78 PACE 1984 due to substantial breaches of the PACE Codes of Practice by the attending officers. He also resisted applications to adduce evidence of bad character.
Following two hours of deliberations, the jury unanimously acquitted AS of all charges.
