Natalie McNamee appears in landmark Supreme Court extradition case

The Supreme Court has recently handed down judgment in Andrysiewicz v Circuit Court in Lodz (Poland) [2025] UKSC 23. This is the first time the Supreme Court has considered the Article 8 bar to extradition since HH [2013] 1 AC 338. The case dealt with the relevance of the prospect of early release from a custodial sentence in Poland on the Article 8 ‘balancing exercise’ – a matter upon which conflicting approaches had emerged from a long line of cases in the High Court.

 

The Supreme Court resolved the matter conclusively in favour of the judicial authority, holding that the prospect of early release will only be relevant in ‘rare cases’.

 

Natalie represented the judicial authority both at first instance and on appeal before Mr Justice Swift in the Administrative Court [2024] EWHC 1399 (Admin).

 

Natalie appeared as junior alone at first instance on appeal, instructed by Kiran Gohal of the CPS Extradition Unit.

 

On appeal, she was led by Louis Mably KC of 6KBW College Hill, and instructed by Nigel Gibbs of the CPS Appeals and Review Unit.
