Richard Jory KC and Madeleine Pinto appear in the Privy Council
On 9 July 2026 Richard and Madeleine attended the Judicial Board of the Privy Council (Lord Briggs, Lord Burrows and Lord Snowden) at the Supreme Court having been given permission to appeal a decision of the Eastern Caribbean Court of Appeal to quash the money laundering conviction of Warren Cassell, a practising attorney in Montserrat. The Court of Appeal had determined that the procedure adopted by the prosecution in Mr Cassell’s first instance trial in the Montserrat High Court was flawed and irregular, that none of the documents should have been shown to the jury in Opening, and that all documents purportedly adduced in the case were inadmissible as they had not been properly exhibited in evidence. Richard argued that the Court of Appeal was wrong in its approach, and wrong to conclude that the documents had not been properly adduced and exhibited. Further, that left as it is, the Court of Appeal’s ruling restricted the ability of the prosecution to present any document heavy case effectively.
The Privy Council will in due course advise the King of its recommendations. Judgement will be provided at a later date.
