Daisy Kell-Jones, instructed by Neil Allan at Tuckers Solicitors, represented a 19-year-old accused of stabbing a member of the public in an unprovoked attack. He pleaded guilty to a charge of s.18 wounding with intent. At sentence, Daisy argued that this was an exceptional case which did not justify a sentence of immediate imprisonment. Daisy argued that on account of the delay in prosecuting the case for no good reason, the Defendant's severe learning disabilities, and the real prospect of rehabilitation that had already occurred prior to charge as the Defendant had moved out of the area and disassociated from the gang influences that he was previously involved with, a sentence in the community could be imposed.

The first instance Judge at Inner London agreed with Daisy’s submissions and imposed a sentence of 20 months imprisonment suspended for 2 years.

The Attorney General referred the case to the Court of Appeal. At a hearing on 24 July 2026, the AG sought to argue that the sentence imposed in the lower court was unduly lenient. Daisy successfully resisted the application by the Attorney General, and the Court of Appeal upheld the sentence of 20 months' imprisonment for 2 years. This means the client can continue his good progress within the community.
